mais habita\u00e7\u00e3o medidas e consequ\u00eancias"},"content":{"rendered":"<p>Aprovado em Conselho de Ministros em Mar\u00e7o passado, o pacote mais habita\u00e7\u00e3o do Governo, foi j\u00e1 submetido a discuss\u00e3o do plen\u00e1rio da Assembleia de Rep\u00fablica e aprovado da generalidade em 19 de Maio de 2023.\nFoi apresentado com o fundamento de ser uma resposta \u00e0 crise na habita\u00e7\u00e3o em Portugal, sendo propostas medidas, visando o aumento da oferta de im\u00f3veis para a habita\u00e7\u00e3o, a simplifica\u00e7\u00e3o dos processos de licenciamento, o aumento do n\u00famero de casas no mercado do arrendamento, o combate \u00e0 especula\u00e7\u00e3o e a prote\u00e7\u00e3o das fam\u00edlias.<\/p>\n\n\n\n<p>Prop\u00f5e para o efeito o Governo:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>converter o uso de im\u00f3veis de com\u00e9rcio ou servi\u00e7os para uso habitacional sem necessidade de revis\u00e3o de planos de ordenamento do territ\u00f3rio ou de licen\u00e7a de habita\u00e7\u00e3o;<\/li>\n\n\n\n<li>Disponibilizar a cooperativas ou promotores privados, im\u00f3veis do Estado em Regime de Contrato de Desenvolvimento para Habita\u00e7\u00e3o (CDH), com a finalidade de constru\u00e7\u00e3o, reconvers\u00e3o ou reabilita\u00e7\u00e3o para programas de arrendamento acess\u00edvel;<\/li>\n\n\n\n<li>mobilizar solos p\u00fablicos para projetos de arrendamento acess\u00edvel.<\/li>\n<\/ol>\n\n\n\n<p>Por sua vez, para simplificar os processos de licenciamento, foi proposto:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>A implementa\u00e7\u00e3o de juros de mora por incumprimento dos prazos de licenciamento pelos munic\u00edpios e entidades externas respons\u00e1veis pelo incumprimento;<\/li>\n\n\n\n<li>O licenciamento com termo de responsabilidade dos projetistas.<\/li>\n<\/ol>\n\n\n\n<p>No que concerne ao aumento de casas dispon\u00edveis no mercado de arrendamento, as medidas que se visa adotar s\u00e3o:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>O refor\u00e7o da confian\u00e7a dos Senhorios, a concretizar atrav\u00e9s do:\n<ul class=\"wp-block-list\">\n<li>arrendamento pelo Estado com vista ao subarrendamento, por forma a garantir a subsist\u00eancia dos Senhorios e a disponibiliza\u00e7\u00e3o imediata de habita\u00e7\u00e3o para agregados familiares com baixos rendimentos ou outras dificuldades no acesso ao arrendamento;<\/li>\n\n\n\n<li>Garantia, por parte do Estado, do pagamento ap\u00f3s tr\u00eas meses de incumprimento, ocupando o Estado, findo aquele prazo, a posi\u00e7\u00e3o do Senhorio na recupera\u00e7\u00e3o dos montantes devidos atrav\u00e9s de execu\u00e7\u00e3o fiscal, promo\u00e7\u00e3o do despejo ou atribui\u00e7\u00e3o de presta\u00e7\u00e3o social ou realojamento;<\/li>\n\n\n\n<li>Redu\u00e7\u00e3o da taxa de IRS para contratos de arrendamento habitacional de longa dura\u00e7\u00e3o.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>O aumento da oferta p\u00fablica atrav\u00e9s da isen\u00e7\u00e3o de tributa\u00e7\u00e3o, em sede de IRS, de mais-valias nas vendas de im\u00f3veis ao Estado.<\/li>\n\n\n\n<li>A promo\u00e7\u00e3o do arrendamento acess\u00edvel, mediante:\n<ul class=\"wp-block-list\">\n<li>Financiamento de \u20ac 150.000.000,00 (cento e cinquenta milh\u00f5es) aos munic\u00edpios para realiza\u00e7\u00e3o de obras coercivas;<\/li>\n\n\n\n<li>Incentivo \u00e0 transfer\u00eancia para habita\u00e7\u00e3o das casas em regime de alojamento local, propondo-se a suspens\u00e3o da emiss\u00e3o de novas licen\u00e7as em todo o pa\u00eds, a necessidade de reaprecia\u00e7\u00e3o das atuais licen\u00e7as em 2030 e sucessivas renova\u00e7\u00f5es quinquenais n\u00e3o autom\u00e1ticas; a caducidade das licen\u00e7as por transmiss\u00e3o;<\/li>\n\n\n\n<li>a possibilidade de os condom\u00ednios porem termo \u00e0s licen\u00e7as emitidas sem a sua aprova\u00e7\u00e3o;<\/li>\n\n\n\n<li>arrendamento obrigat\u00f3rio de casas devolutas pelo Estado para posterior subarrendamento;<\/li>\n\n\n\n<li>isen\u00e7\u00e3o fiscal quanto aos im\u00f3veis afetos a programas de arrendamento acess\u00edvel, com a implementa\u00e7\u00e3o de taxa de IVA de 6% para empreitadas de constru\u00e7\u00e3o ou reabilita\u00e7\u00e3o, a isen\u00e7\u00e3o por tr\u00eas anos de IMI ap\u00f3s reabilita\u00e7\u00e3o e a isen\u00e7\u00e3o de IMT nas compras para reabilita\u00e7\u00e3o com vista a PAA.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p>Relativamente ao combate \u00e0 especula\u00e7\u00e3o, as medidas assentam essencialmente:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>no fim dos vistos Gold, salvaguardando-se que a renova\u00e7\u00e3o daqueles que j\u00e1 foram atribu\u00eddos ocorrer\u00e1 apenas se o im\u00f3vel que serviu de base ao investimento for destinado a resid\u00eancia pr\u00f3pria e permanente do propriet\u00e1rio ou descendente, ou objeto de contrato de arrendamento para fins habitacionais por per\u00edodo n\u00e3o inferior a cinco anos;<\/li>\n\n\n\n<li>na garantia de renda justa em novos contratos de arrendamento, pro\u00edbe-se, no caso de um im\u00f3vel j\u00e1 arrendado e a ser feito um novo contrato, um aumento superior a 2% do valor da renda, sem preju\u00edzo das atualiza\u00e7\u00f5es com base nos coeficientes do INE.<\/li>\n<\/ol>\n\n\n\n<p>Por fim, quanto \u00e0 prote\u00e7\u00e3o das fam\u00edlias, prop\u00f4s-se:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>a isen\u00e7\u00e3o de IRS relativamente a mais-valias para amortiza\u00e7\u00e3o de cr\u00e9dito \u00e0 habita\u00e7\u00e3o do pr\u00f3prio e descendentes;<\/li>\n\n\n\n<li>no \u00e2mbito do cr\u00e9dito \u00e0 habita\u00e7\u00e3o, a obrigatoriedade de os bancos oferecerem uma taxa fixa e  prote\u00e7\u00e3o na subida das taxas de juro;<\/li>\n\n\n\n<li>o apoio extraordin\u00e1rio ao pagamento de rendas a agregados familiares com taxas de esfor\u00e7o superiores a 35%, at\u00e9 ao sexto escal\u00e3o de rendimento;<\/li>\n\n\n\n<li>a prote\u00e7\u00e3o de arrendat\u00e1rios com arrendamentos celebrados antes do RAU, ou seja, antes de 1990, quando o seu rendimento anual bruto corrigido for inferior a 5 vezes a retribui\u00e7\u00e3o m\u00ednima nacional anual, quando tenham idade igual ou superior a 65 anos ou defici\u00eancia com grau comprovado de incapacidade igual ou superior a 60%.<\/li>\n<\/ol>\n\n\n\n<p>E por forma a assegurar a prote\u00e7\u00e3o destes arrendat\u00e1rios, veio o governo sugerir:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>a isen\u00e7\u00e3o de IRS sobre os rendimentos provenientes do arrendamento e IMI aos senhorios destes contratos;<\/li>\n\n\n\n<li>a regulamenta\u00e7\u00e3o da compensa\u00e7\u00e3o ao senhorio pelo n\u00e3o aumento das rendas; e<\/li>\n\n\n\n<li>a garantia da n\u00e3o transi\u00e7\u00e3o dos contratos para o Novo Regime do Arrendamento Urbano (NRAU).<\/li>\n<\/ol>\n\n\n\n<p>Justi\u00e7a mais r\u00e1pida e eficaz, com a cria\u00e7\u00e3o de um balc\u00e3o \u00fanico de arrendamento, com a cria\u00e7\u00e3o de um balc\u00e3o de arrendamento que agregue o Servi\u00e7o de Injun\u00e7\u00e3o em Mat\u00e9ria de Arrendamento (SIMA) e o Balc\u00e3o Nacional do Arrendamento (BNA), com vista \u00e0 simplifica\u00e7\u00e3o do seu funcionamento e ao refor\u00e7o das garantias de senhorios e
